Accepting our Terms of Use. By using any of GearHippo's services including the use of the website, GearHippo.com, or any other GearHippo services (collectively, the "Services"), you agree to the following terms and conditions including any future modifications (collectively, the "Terms of Use"). If you do not agree with any of our Terms of Use, please stop using the Services.

Changes to our Terms of Use. GearHippo may change the Terms of Use at any time for any reason.  All changes can be found at the GearHippo Terms of Use page (http://gearhippo.com/#copy.terms_of_use) and once posted are immediately enforceable.  Please review this page regularly for any updates to the Terms of Use.

Changes in and Availability of Service. GearHippo provides its Services on an as is and as available basis. GearHippo is not responsible or liable for the availability, timeliness, security or reliability of the Services. GearHippo may also modify, suspend or discontinue the Services at any time and without any liability to you. GearHippo has no responsibility for any content removed from the site (through deletion, failure of storage, or any other reason).

User Posted Content. GearHippo bears no responsibility for the content posted to GearHippo.com by its users. GearHippo uses a self-publishing system, and does not screen user content before it is posted to GearHippo.com. All content (including links to other 3rd party sites) posted to GearHippo.com is the responsibility of the user who posted the content and is posted at the user's own risk. By using GearHippo you may encounter content that you find objectionable, offensive, or inappropriate and you agree not to hold GearHippo liable.

Content Linked to by GearHippo. GearHippo bears no responsibility for the content linked to by the GearHippo Services. Content from third party sites are developed by people over whom GearHippo exercises no control. All content linked to from GearHippo.com or found through any link on GearHippo.com is the responsibility of the third party who originally developed the content.

Transactions. Any relationship that you develop through GearHippo is between you and the other party involved. GearHippo is not responsible or liable for any loss or damage from any dealings of any kind.  If users of the site, or users and a third party on this site have a dispute, GearHippo has no obligation to get involved.  If a dispute does arise you hold harmless and indemnify GearHippo and everyone involved or associated with GearHippo.  If you are a California resident you wave Civil Code Section 1542.
           
Copyright Violation. GearHippo will remove any copyrighted material per the Digital Millennium Copyright Act (DMCA). If your material has been copied in any way that violates your copyrights, let us know at team@gearhippo.com.  In your message, please provide us with the following information: your name and complete contact information, where we can find the copied material on GearHippo.com, a statement saying that the material is not authorized for use by the infringers, an affidavit saying that you are the owner of the disputed material or that you are authorized to act on its behalf, and your signature (electronic or real).
 
Privacy Disclosure. GearHippo’s Privacy Policy can be found at the GearHippo Privacy Policy page (http://gearhippo.com/#copy.privacy_policy) and explains how any collected information is used.  By using GearHippo you are agreeing to the GearHippo Privacy Policy. GearHippo may save or disclose any information gathered while using this site if required by law or if we feel it is necessary.

Appropriate Conduct. You agree that you are responsible for your own conduct while using GearHippo and for all consequences of your behavior. You agree to use GearHippo's Services only for legal and proper purposes. By way of example, and not as a limitation, you agree that when using GearHippo you will not:

• post, email, or make available any content that:
• is illegal, inappropriate, misleading, fraudulent, or prohibited by these Terms of Use;
• infringes the proprietary rights of any party, unless you are the owner of such rights or have the permission of the owner to post such content;
• use GearHippo Services for any illegal or unauthorized purpose;
• contains any form of advertising or solicitation if: posted in areas of the GearHippo website not designated for such purposes; or emailed to GearHippo users who have not indicated in writing that it is ok to contact them about commercial interests;
• implies that such content is sponsored or endorsed by GearHippo;
• interfere with or disrupt GearHippo Services including servers or networks connected to GearHippo Services, or disobey any policies of networks connected to GearHippo Services;
• remove any copyright, trademark or other proprietary rights notices contained in or on GearHippo Services;
• violate the legal rights of other GearHippo users;
• create user accounts by automated means or under false or fraudulent pretenses;
• use any robot, spider, site search application, or other device to retrieve or index any portion of GearHippo Services or collect information about users for any unauthorized purpose;
• transmit any viruses, worms, defects, or any items of a destructive nature.

No Spam. Sending unsolicited emails through the GearHippo mailing system is not allowed.  Any unauthorized use of GearHippo computer systems is not allowed and may be a violation of federal and state laws: Computer Fraud and Abuse Act (18 U.S.C. § 1030 et seq.), Section 502 of the California Penal Code and Section 17538.45 of the California Business and Professions Code.  Violations may result in civil and criminal penalties.

Personal Use. GearHippo grants you the revocable right to use GearHippo for your personal use only. This right does not include any collection, aggregation, copying, duplication, display or derivative use of the GearHippo nor any use of data mining, robots, spiders, or similar data gathering and extraction tools for any purpose unless expressly permitted by GearHippo.  The only exception is for certain sites (search engines and non-commercial public archives) that use these kinds of tools to display hyperlinks to GearHippo, as long as they are from stable IP addresses.  GearHippo uses the term 'search engines', which does not mean a classified listing site.  You may have a hyperlink to specific listings on GearHippo if it is for non-commercial use or news reporting.  You may not display more than 100 links to the GearHippo website. You can also create a hyperlink to GearHippo's homepage as long as its done in an appropriate manner.  You can use GearHippo’s RSS feed if its for personal, non-commercial use, a blog, or through third party aggregators, as long as the titles link back and match the actual postings, you show GearHippo as the source of the listing, the listing does not reflect any views of any third party, the RSS feed is not redistributed, and the third party use does not put an extraordinary strain on the GearHippo system.  GearHippo maintains all rights of the content found on the RSS feed and can delete them at any time for any reason. Any use not authorized by GearHippo will terminate your use of the site.  To use GearHippo for any reason not covered within these Terms of Use, express written permission must be granted to you by GearHippo. 

Disallowing Use. GearHippo reserves the right to terminate your use of GearHippo Services, by any means, at any time, for any reason, with no fault to GearHippo. Once your use has been terminated, you cannot return to GearHippo.com or continue to use GearHippo Services. 

GearHippo's Rights. The GearHippo website and its content are fully protected by copyright laws and international treaties. You may not copy any part of the GearHippo website without the express written permission of GearHippo. You may not decompile or disassemble, reverse engineer or otherwise attempt to discover any source code contained in GearHippo.com.  You can not use any aspect of the site for commercial purposes. By posting any content to GearHippo, you give GearHippo the right to control that information in any way GearHippo wants. 

DISCLAIMER OF WARRANTIES. YOU ARE USING GEARHIPPO AT YOUR OWN RISK. GEARHIPPO IS PROVIDED ON AN 'AS IS, WHERE IS' BASIS, WITHOUT ANY WARRANTIES OF ANY KIND WHETHER EXPRESS OR IMPLIED.  GEARHIPPO AND ITS LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THOSE OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. GEARHIPPO DOES NOT WARRANT THAT ITS SITE, SECURITY, RELIABILITY, TIMELINESS, ACCURACY, PERFORMANCE, CONTENT OR SERVICES ARE APPROPRIATE FOR YOUR INTENDED USE, OR THAT THE SERVICES WILL MEET YOUR REQUIREMENTS. GEARHIPPO IS NOT RESPONSIBLE FOR ANY VIRUSES OR OTHER HARMFUL COMPONENTS FOUND IN CONNECTION WITH GEARHIPPO. Certain jurisdictions do not allow for disclaimers of implied warranties so these disclaimers may not apply to you.

LIMITATION OF LIABILITY. GEARHIPPO WILL NOT BE HELD LIABLE IN ANY WAY RESULTING FROM THE USE OR MISUSE OR ANY ACTION PERTAINING TO GEARHIPPO. THIS LIMITATION ALSO APPLIES TO ANYTHING RECEIVED THROUGH OR ADVERTISED IN CONNECTION WITH THE GEARHIPPO SITE OR ANY LINKS FOUND ON THE SITE. THESE LIMITATIONS APPLY TO THE FULLEST EXTENT OF THE LAW. Certain jurisdictions do not allow for disclaimers of implied warranties so these disclaimers may not apply to you.

INDEMNITY. YOU AGREE TO INDEMNIFY AND HOLD GEARHIPPO AND ALL PARTIES ASSOCIATED WITH GEARHIPPO HARMLESS FROM ANY THIRD PARTY CLAIM ARISING FROM OR IN ANY WAY RELATED TO YOUR USE OF GEARHIPPO SERVICES, INCLUDING ANY LIABILITY OR EXPENSE ARISING FROM ANY CLAIMS, LOSSES, DAMAGES, SUITS, JUDGEMENTS, ATTORNEY FEES AND COURT COSTS.

Enforcement. You understand that because damages are often difficult to quantify that if it becomes necessary to pursue any action to enforce these Terms of Use, you will be liable to pay GearHippo any and all costs including but not limited to attorneys fees. Otherwise, you agree to pay GearHippo's damages, to the extent that actual damages can be reasonably calculated.

General. These terms represent an agreement between you and GearHippo and govern your use of the site. The laws of the State of California shall govern the Terms of Use and your relationship with GearHippo. You agree to submit to the jurisdiction of the courts within the city and county of San Francisco, California. By not enforcing or exercising a right in the Terms of Use, GearHippo does not wave that right. If one part of the Terms of Use is found to be invalid by a court, it does not mean the entire Terms of Use is invalid; every other section of the Terms is still in effect and valid.  You agree that any claim related to the use of GearHippo Services or the Terms of Use must be filed within six (6) months after the incident takes place, or it shall forever become barred.
